General Terms and Conditions (GTC)
for Psychological Counseling Zurich

Section 1: Scope and Contracting Parties

These General Terms and Conditions (GTC) apply to all services (individual counseling, couples counseling, and emergency sessions) provided by Frank Mitteldorf / Psychological Counseling Zurich, domiciled in Zurich, Switzerland (hereinafter referred to as the "Provider"). By booking an appointment (online, by phone, or in writing), the client agrees to these GTC.

Section 2: Services and Billing

1. The Provider's services are delivered as psychological counseling or coaching. Sessions take place either at the practice in Zurich or online.

2. The regular hourly rate depends on the type of counseling:

Individual Counseling: CHF 160.– per hour. Session duration is 60 to 90 minutes.

Couple Counseling: CHF 180.– per hour. These sessions take place in person at the practice; session duration is 90 to 120 minutes.

Emergency Sessions: CHF 180.– per hour. Emergency sessions take place online; session duration is 90 to 120 minutes.

3. Billing is based on a minimum of 60 minutes for individual and 90 minutes for couples and emergency counseling sessions. After this the actual time spent is billed in standard 5-minute increments, calculated at the respective hourly rate.

4. The hourly rate includes all costs for preparation, documentation, administration, and statutory value-added tax (VAT). No additional fees apply.

Section 3: Payment Terms

1. Invoicing is sent via email, or payment can be processed directly via TWINT.

2. Invoices are payable in full without deductions within a payment period of 14 days from the invoice date.

Section 4: Delays and Cancellations

1. Delays: If the client arrives late, the scheduled time slot remains unchanged. Lost time cannot be made up for or added to the end of the session. The full booked time will be charged. Delays must be reported to the Provider via mobile phone as soon as possible.

2. Cancellations by the Client:

Cancellations made more than 2 business days prior to the scheduled appointment are free of charge.

Cancellations made less than 2 business days prior to the appointment or no-shows will be billed at the full session rate.

3. Bookings via Online Scheduling Tool: For appointments booked directly through the online scheduling tool, the same rule applies: In the event of a cancellation or absence without timely notice, 100% of the session fee will be charged.

Section 5: Debt Collection and Default in Payment

1. If the client is in default of payment, a first payment reminder will be sent free of charge.

2. For further reminder effort, the Provider charges a fee of CHF 35.– for the 2nd reminder and a fee of CHF 85.– for the 3rd reminder.

3. If a claim is not settled following the 3rd reminder, the Provider reserves the right to initiate legal action (debt enforcement proceedings / Betreibung). In this case, all incurred official fees (pursuant to Art. 68 SchKG) will be billed to the client in full.

Section 6: Jurisdiction and Applicable Law

The contractual relationship between the Provider and the client shall be governed exclusively by Swiss law. The exclusive place of jurisdiction for all disputes is Zurich, Switzerland.
